Terms and conditions for 2024 Climate Action Trail Quiz Competition
By entering this competition, entrants are deemed to have read, understood and accepted the following terms and conditions:
A. Competition and entries

This competition is being run by Auckland Council (Council). The purpose of the competition is to promote and evaluate the success of the new Climate Action Trail at the Botanic Gardens.
More details about the prize are set out below.

Every eligible person who completes the Microsoft form (Quiz) between 3:00pm Monday 30 September 2024 to 6:00pm Monday 2 December 2024 (Competition Period) will be entered into the prize draw. Maximum of one entry per each eligible person. Entries made before or after the Competition Period will not take part.

Should the minimum number of entries (300) not be met, Council reserves the right to extend the Competition Period end date to Monday 13 January 2025 (Extended Date). Should the minimum number of entries not be met by the Extended Date, the prize draw will take place 5 working days after the Extended Date.

The competition is open to Auckland residents aged 18 years and over.

Entrants who complete the Quiz before or after the Competition Period will not be considered in the draw.

Entrants must ensure their details, including phone number and email address, are up to date on Council's system.
B. Prize, selection and prize draw

The prize includes a Xiaomi Electric Scooter 4 Go with a maximum value of $499.

The winner will be determined by a draw from all valid entries between 9:00am and 5:00pm on Monday 9 December 2024.

If the Competition Period is extended, a draw from all valid entries will take place five working days after the Extended Date between 9:00am and 5:00pm.

Competition winners will be contacted by email.

If winners do not reply to the email within three working days, they will be contacted via text. If there is no reply to the text within three working days, they will be contacted by phone call.

If the winner still cannot be reached after two weeks from the draw, Council will redraw a winner on the same terms as the original draw, for the relevant prize, and will contact the new winner by email.

Auckland Council’s decision is final and no correspondence will be entered into.
C. Prize terms

The prize includes a Xiaomi Electric Scooter 4 Go valued at $499 NZD.

The prize will be delivered to the address provided by the winner. The delivery address must be located within the Auckland region.

Council will pay the cost of delivery within the Auckland Region.

If the winner elects not to have the prize delivered, the winner must pick up the prize from Te Kaunihera o Tāmaki Makaurau (Auckland Council) building at 135 Albert Street, Auckland CBD.

The prize is not redeemable for cash, not transferable to any other person, and cannot be used in conjunction with any other offer or promotion.

The prize is subject to availability. If any prize or part of a prize becomes unavailable for any reason, Council reserves the right to change the prize acting reasonably. This includes providing a winner with a substitute prize, either in full or in part, at the same or higher value.
D. Privacy

Council may use entrants’ personal information from entries to conduct the competition and as contemplated by its privacy policy below. Winners consent to participate and co-operate as reasonably required in all promotional activities relating to the competition, without compensation, and to having their personal information used for such purposes.

All entries remain the property of Council. All personal information provided by the entrants will be collected, used, stored, disclosed and corrected in accordance with the Privacy Act 2020 and Council's privacy policy which can be viewed here. All entrants have the right to access their information and request for any personal information to be corrected.
E. Exclusions

The following people are not eligible to win the prize:
a. anyone under the age of 18 at the time of entering the competition;
b. anyone who is not a resident of Auckland at the time of entering the competition.

Council reserves the right to verify the validity of entries. Council also reserves the right to exclude from the competition or refuse to award any prize to an entrant who is in breach of or who fails to comply with these terms and conditions, gained an unfair advantage in participating, or won a prize by using fraudulent means (including providing false or misleading details).

Council will not be responsible for any late, lost or misdirected entries, or transmission or receipt of any incorrect information associated with entries, including but not limited to entries not received due to technical problems. Without limiting any rights entrants may have under the Consumer Guarantees Act 1993, Council will not be liable for any claims for loss, damage or injury whatsoever or for any physical or mental injury suffered by any entrant or competition winner as a result of, or in connection with, the competition or due to the prize won in the competition.

Council reserves the right to amend or change these terms and conditions at any time, acting reasonably, including amending, extending, postponing or cancelling the competition.

To the extent that any matter relating to the competition is not covered by these terms and conditions, Council reserves the right to conduct the competition as it reasonably sees fit, subject to any legal requirements.

All decisions of Council are final and no discussions or correspondence will be entered into. Failure by Council to enforce any of its rights under these terms and conditions at any stage does not constitute a waiver of those rights.

These terms and conditions shall be governed by and construed in accordance with the laws of New Zealand and be subject to the non-exclusive jurisdiction of New Zealand courts.
